What are the penalties if convicted of Domestic Violence or Assault?

The penalties vary depending on the severity and classification of the charge. If a domestic violence misdemeanor conviction, the penalty can range from 30 days to up to 180 days in jail and a fine from $250 up to $1,000. As to a felony conviction, incarceration increases from 12 months up to 36 months with fines from $2,500 up to $10,000. If a misdemeanor assault, the penalty is up to 180 days in jail and a fine of up to $1,000. A felony conviction for assault can result in up to 8 years of incarceration and a fine of up to $15,000. The sentence can also include probation, counseling, and restrictions on gun ownership.

Do I need a lawyer, and how do I find one?

We strongly recommend that those charged with any crimes, including domestic violence retain an experienced criminal defense attorney. If you are not able to afford an attorney, you may qualify for the services of a public defender. If hiring your own attorney, be sure to read all reviews, and spend time discussing the case at a free consultation. You should never go into court without an attorney when facing criminal charges.

What should I say or not say to the police?

Generally, it is advisable not to talk to the police when charged with crime. You have the right to remain silent and not incriminate yourself. Any statement you make to the police, may be used against you in a court of law.

What should I expect during the court process?

Initially, there will be an arraignment in which you will go before the court and be formally charged. You will enter a plea and address bail. Next discovery will be conducted resulting in the exchange of information between the prosecution and yourself. After discovery, there will be a plea bargain proposal which if accepted, will move the case into sentencing. If not, a trial will be scheduled and conducted by the court.
